Terms of Service

Acceptance of Terms
By creating an account or using Kiosku in any way, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
These terms form an agreement between you (the merchant) and Sebastian Arthur Chua, the individual operating Kiosku as a sole trader based in Sydney, New South Wales, Australia.
What Kiosku Is
Kiosku is an order-management dashboard for small businesses that sell through chat channels such as WhatsApp and Instagram DM. It lets you track orders, manage payment status, and optionally share a checkout link so customers can place orders themselves — all from a single dashboard.
Kiosku is a tool for merchants. It is not a marketplace, payment processor, or logistics provider.
Eligibility
You may use Kiosku only if you are a business or sole trader that is legally permitted to sell goods or services in your jurisdiction. By using Kiosku you represent that:
- You are operating a legitimate business or trade.
- You have the legal authority to enter into this agreement on behalf of that business.
- Your use of Kiosku complies with all applicable laws in your jurisdiction.
Account Responsibilities
When you create an account, you agree to:
- Keep your login credentials secure and not share them with others.
- Take responsibility for all activity that occurs under your account, whether or not you authorised it.
- Provide accurate and up-to-date information when registering.
- Operate one account per business.
If you suspect unauthorised access to your account, notify us immediately at sebastian.a.chua@gmail.com.
Acceptable Use
You must not use Kiosku to:
- Sell illegal goods or services.
- Send spam or unsolicited communications to customers.
- Abuse, harass, or harm other users or third parties.
- Scrape, copy, or reproduce any part of the platform without permission.
- Reverse-engineer or attempt to extract the source code of Kiosku.
- Circumvent any security or access controls.
- Impersonate another person or entity.
- Use the service in any way that violates applicable law.
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
Merchant Content and Data
You retain full ownership of your store data and your customers' data. By using Kiosku, you grant Sebastian Arthur Chua a limited, non-exclusive licence to store, process, and display that data solely to operate and improve the service.
By uploading customer information (names, contact details, addresses), you warrant that you have a lawful basis to do so under applicable data protection law — for example, that your customers have consented or that you have a legitimate business reason to process their data.

Payments
Kiosku is currently free to use during early access. We do not charge subscription or platform fees at this time.
If you use Kiosku's payment collection features, transactions are processed by third-party payment providers — currently Stripe and Xendit. Those providers charge their own processing fees, which are passed through to you. We do not hold, manage, or have access to your merchant funds.
Your use of Stripe and Xendit is governed by their respective terms of service. You are responsible for complying with those terms.
Third-Party Services
Kiosku relies on third-party infrastructure providers including Stripe, Xendit, Supabase, and Vercel. These are independent companies with their own terms, policies, and service levels. We are not responsible for any outages, data loss, or other issues caused by those providers.
Links to or integrations with third-party services are provided for your convenience and do not constitute an endorsement.
Service Availability
We aim to keep Kiosku available and reliable, but we cannot guarantee uninterrupted access. At this early stage, there is no formal uptime commitment.
We may add, remove, or change features at any time. If we plan to discontinue the service entirely, we will give you reasonable advance notice so you can export your data.
Disclaimer of Warranties
To the fullest extent permitted by law, Kiosku is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be error-free, uninterrupted, or free of harmful components.
Limitation of Liability
To the fullest extent permitted by law, Sebastian Arthur Chua's total liability to you for any claim arising out of or related to these terms or the service is limited to the fees you paid to us in the 12 months preceding the claim — or AUD $100, whichever is greater. Because the service is currently free, the effective cap is AUD $100 for most users.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities.
Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law in Schedule 2) or any other applicable Australian law that cannot lawfully be excluded. Where legislation implies a guarantee or condition into these terms that cannot be excluded, our liability for a breach of that guarantee or condition is limited, to the extent permitted by law, to re-supplying the relevant service or paying the cost of having it re-supplied.
Indemnity
You agree to indemnify and hold harmless Sebastian Arthur Chua from any claims, damages, costs, and expenses (including reasonable legal fees) arising from:
- Your content or data uploaded to Kiosku.
- Your misuse of the service.
- Your breach of these terms.
- Your violation of any third-party rights or applicable law.
Termination
Either party may terminate this agreement at any time. You can close your account by contacting us. We may suspend or terminate your access if you breach these terms or for any other reason at our reasonable discretion.
On termination, your data is retained in accordance with our Privacy Policy and deleted on request.
Changes to These Terms
We may update these terms from time to time. For material changes, we will notify you by email or through an in-app notice before the changes take effect. Your continued use of Kiosku after the effective date of updated terms constitutes your acceptance of those changes.
We recommend checking this page periodically. The effective date at the top will tell you when the terms were last updated.
Governing Law and Jurisdiction
These terms are governed by the laws of New South Wales, Australia. Any disputes arising from or related to these terms or the service will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
